the congress can not create exceptions beyond the reach of judicial authority or review

Article 3 of the constitution grants the judiciary authority in laws and equity arising under the constitution but limits the authority to mostly public officials, magistrates and disputes between states while granting appellate authority at the discretion of congress. It also grants congress the authority to exclude legislation from judicial oversight with the exceptions clause. So, far from the judiciary being supreme interpreter of the constitution, the Court mainly derives its power from the legislature. (Someone should inform Anthony Kennedy)
