Collection Agency Blog 2

I looked on RATEITALL for a section on rating collection agencies. this is all I found so far. I am writing to ask if anyone out there has had experiences with collection agencies calling them trying to collect on debts. In our case this debt is not even ours but a relative who died almost two years ago. Much as I can figure when they tried to find her they got my phone number as well. I have not picked up just let the voice mail take it. each time we get a recording telling us they are looking for my relative and how is she going to make arrangements on paying them. I have been reading online about this particular agency called Allied interstate, and hear they are very nasty. they cuss at people call them liars, demand payment even when told they have the wrong person and we do not have any debts turned into collections. I was wondering if anyone out there has heard of Allied Interestate, or got stuck dealing with these kind of agencies? So far some of the stuff I have read about this company is bad, they sound like real bullies.sorry to put it on this category about blogs. could not find anything else i could put it on.would appreciate any advice.  UPDATE: after four months  i finally called Allied and told them my relative died two years ago.she did not have an executor to her will. We did send death certificates to some places she owed money and a small  note that said she died with no money. the woman   says my husband's nameand asks if I know him. I said yes. she did not give me a chance to say anything.all he did was send a small note saying she was deceased. we were not her executor though. she had a very old will and the those they assigned were all dead. Now allied is implying they are turning it over for payment after she asked about my husband and is trying to say he must be the executor. he is not. can they try and collect from us just because we sent a death certificate.? he did not  say he was executor. can they actually try and get money from us now? again, we ARE NOT The Executors!  she did not say what the debt was for.and why my husband's name has come up. I would appreciate it if anyone has had any experience with one of these scummy places what we should do. We have never co-signed on anything of hers. and we have never sent anything claiming to be her executor. since we are NOT. Can anyone out there give us their ideas what we should do. We do not in anyway owe money from my mother.  sorry this is so long!  how big of crooks can these jerks be.I know they like to use scare tactics. and others have said to not let them scare us into paying a debt that we have no resposibility for.

I truly wish I had some way to look up some reputable resources for you, but it looks like it's something that can vary by state. It's heartless what these people are doing to you and your husband, I hope this can be resolved soon!

thanks kamylienne. sounds like this place found our names and are trying to pin her debts on us.I was never given the chance to say anything but yes to my name and yes I knew the person when she announced my spouse's name.she said "I am sending this to support{whatever that is} and hung up on me.she never gave me the chance to say we were not the executors of her estate.my mother died with no money. she was an advid spendthrift and died with no cash to pay what we think were her credit card debts. AI would not tell us what the debt was. just wanted us to confirm our names.I personally cannot see how they can force us to pay her debts we did not have a name on. hear they are awful bullies and will try any scare tactic they can. the only reason I called today is my brother got a threat letter trying to collect on another one of my mother's debts.and that was a mess too.

I sent you a private message with specific instructions. Did it reach you? I understand RIA has recently had a problem with some PMs so if it didn't get to you I'll write it out here.

Molfan, I read your blog and really am on the other side of the fence, but do empathize with your situation. See having been a commercial bill collector for over 10 years I am pretty aware of what many of these collection agencies are like. I do not deal with retail collections, but I know it very well. There a many different ways to deal with a consumer collection agency, but in order for you to get the best result you have to submit everything in writing and follow due process. You see most people will not go that far with a collection agency, and on the same token, most people who are debtors will make every attempt to get the collector off the phone. Considering that you are protected by many consumer protection laws, if you do the footwork to validate that the debt is indeed not yours, the collection agency will be forced to leave you alone. So the next time a collection agency contacts you, first tell them that they must send everything to you in writing and that you are not able to communicate by phone. Next in writing, provide documentation to support your claim. Here's one last hint, if the collection agency reveals to you anything about the debt, it is a violation of the Fair Debt Collection Practices Act, and is serious. There are many great retail collection agencies out there (as well as commercial collection agencies) unfortunately with so many agencies, only after weeding through do you find many that respect the rights of consumers, are professional, and most importantly are making an honest living. Sorry for you hardship, if indeed you are in the right, stand your ground, and the collection agency will have to respect your demands.
