Hirabayashi v. United States (1943)

Issue: Whether the President’s executive orders and the United States Congress’ ratification of the executive orders exceeded the constitutional powers of the national government to impose restrictions on individuals of Japanese descent and whether the national government violated Japanese descendants’ due process. Decision: In a unanimous decision, the Supreme Court found the President's orders to be constitutional.

A judicial decision made in a climate of fear and racism, this may well be the worst major ruling of the court.

It legitimized the executive branch's trampling of due-process and effective theft of property.
