I bought several Verizon Ringtones and then upgraded to a new phone. According to the Ringtone Terms and Conditions, I have a license to use these ringtones for a year. However, Verizon wants me to re-purchase the ringtones I hold a year-long license to transfer them to my new phone. Their Terms and Conditions do not say anything about this for either Ringtones or Phone Upgrade. The Customer Server Representative verified verbally that neither of these Terms and Conditions state anything about having to re-purchase my already purchased ringtones during a conversation on 5/11/09 around 2pm MDT, which I confirmed that Verizon recorded. I believe this is fraud because they are attempting to charge me for something I have already paid for. Ironically, while the customer service rep was checking the Terms and Conditions to verify, the ad playing on the phone said that I could get new equipment and return it within 30 days AT NO CHARGE. I just had an issue with them the day before where they were trying to CHARGE ME A RE-STOCKING FEE because I returned a cell modem within 30 days. If I had not saved the chat text with one of their reps stating clearly that there were NO CHARGES if I returned it within 30 days, they would have charged me. Do you see the pattern here?

Do you understand that ringtones aren't the property of Verizon Wireless? Do you understand that the artist who recorded these songs is entitled to royalties? Do you understand that file-sharing and transferring is illegal? Okay... Think of it this way: if you buy a house and paint all of the walls blue, then decide to move somewhere else, do you think your landlord should reimburse you for paint?

If you volunteer to get another phone, you must repurchase the songs. Verizon Wireless isn't responsible for buying new ones for you.

Well golly gee-whiz, Marachelle. Oh I understand exactly how it works. First, I'm not "file-sharing". Second, I'm not "transferring" except to my cell phone. None of those are violations of the law. If I buy media, I'm entitled to transfer it to my cell phone. If I lose my cell phone, it doesn't mean I have lost ownership of the media. It just means I'm entitled to transfer it to my new phone because I have already purchased the right to do that. I have asked your customer service repeatedly to send me a copy of the copyright text that says this is prohibited. You know what? They can't find it because it's not there. This thing about me repurchasing what I already own is a Verizon thing. I don't have that problem on Napster. So for all of your ranting, you know less about how media copyright works than I do. But, don't worry, I have filed a compliant with the FCC and they are pursuing it. Apparently, they have a similar understanding of copyright laws as I do.

Well, aren't you charming.

A) your original post doesn't mention "losing" your phone -- you clearly said that you upgraded, which is a VOLUNTARY equipment change. Verizon Wireless has a Media Retrieval program you can utilize if your phone is lost, stolen, or broken. You should look into it.

B) Verizon Wireless wouldn't have anything about what happens to your ringtones when YOU lose your phone, because only the company from which you purchased them would provide the Terms & Conditions for the item. Stupid.

C) I don't work for Verizon Wireless -- that was never mentioned in my post, you may wish to go back and re-read my comment to get your facts straight. I'm just a customer who ISN'T a douche-bag and understands that Verizon Wireless provides me with cell service, but is not required to wipe my ass and babysit me.

Best of luck with the FCC. I'm sure your measly little complaint will be taken seriously.

Marachelle, plz air your personal issues somewhere else. You obviously don't know what you're talking about. I know that's embarrassing when someone exposes that. But, instead of digging the hole deeper, why don't you just stop digging. Thank you.
