CLASS ACTION LAWSUIT NEEDED!!!!

Like the rest of you, i play by the rules, work hard for my money, and can admit when i make a mistake however.......

After numerous overdraft fees from this bank i finally surfed the net "Key Bank Class Action Lawsuit" and found this site. I NEVER post things for any reason but this has got to stop with Keys unethical overdraft practices. This most recent overdraft almost made me cry. Here's what happened.......

Friday July 4th 2008. Account Balance positive $52. I Deposit personal check from rental tenant into Key Bank ATM for $450.

Over the holiday weekend spent roughly $200 with Key Bank Debit Card.

Total overdraft fees after weekend = -$268.


Sooo here's the problem. Key bank says that i was allowed $100 good faith credit for the deposit of the check during that weekend. Any transactions above $152 resulted in a overdraft fee since the check was not yet cleared. The purchases above $152(McDonald's for the family, a U.S. Flag blanket for the Fireworks picnic, Gas for the car and snacks for the picnic.) resulted in overdraft fees. When Monday rolled around and i got online and saw that i was in the negative i naturally called to get this all straightened out. To make a very run around story short, i left the Executive Key-bank representative speechless when i said simply,..... "I totally understand limiting my funds until the check has cleared because you don't know if there is a check until Monday and u verify that it is legitimate, so automatically giving overdraft fees is a natural defense by a bank to deter excessive Non Sufficient Funds transactions. HOWEVER once the check is cleared the bank should carry the responsibility of reimbursing the overdraft fees because they now know that the money spent was truly there."

Its simple, you are my bank, i allow you to hold my money so that i can avoid walking around with wads of cash and be able to make transactions via a debit card whenever i cant be there in person (Ex. Internet transactions). When i give you my money to hold i understand you will use my money and other peoples money to invest in loans and other legitimate financial tools. When i need to withdraw my money for my own personal transactions i expect my money to be there. The line is crossed when you find ways to take advantage and manipulate our willingness to allow you to hold our money. When a banking institution recklessly and excessively manipulates its customers and creates legal policies allowing loopholes like this to happen unchecked, we the people are then obligated to call for correction in the form of a Class Action Lawsuit.

FACT: Keybanks online banking for customers has a ILLUSION loophole. When a employee of Keybank accesses your information they see your transaction history in REAL TIME (When the merchant is paid). When you as a customer look online via there online banking you see a TRANSACTION HISTORY (When you made the transaction) that does not show what the Key Bank Employee sees. YOU see when the actual transaction took place, KEY BANK sees when they actually paid the merchant, sometimes 2 weeks later. The reality is that the lower level employees don't see that bogus sheet your reading on the Internet so they think you are crazy, meanwhile you cannot see the real time transactions so you think they are crazy. They purposely keep you and there own employees in the dark, looking at separate forms. As all of us know who are on this website the employees are limited in there ability in offering you a refund but are allowed to give you so many in a 12 month period. So you Feel like you compromise when they allow you %50-%75 of your wrongfully stolen money bank once or twice. The truth is that both you and the employees should be allowed to see BOTH the Real Time transactions and the Transaction History. This would make more employees understand the customers point of view and allow the customer to monitor the banks actions and demand an explanation as to why it took them 2 weeks to pay the transaction. The Grounds for a class action lawsuit is the fact that AVAILABLE BALANCE is a DELIBERATE MISREPRESENTATION OF FUNDS.

Fact: Key Banks computer system is designed to hold certain transactions, then to compound them all at once resulting in overdraft fees. Take a look at your online banking statement next time you go into the negative. Notice that transactions you though cleared weeks ago suddenly end up in the overdraft section, and that all of the big monies spent for each overdraft day come before the smaller transactions. If they did it in reverse there would be less overdraft fees. Grounds for Class Action Lawsuit, DELIBERATE CALCULATED THEFT of SMALL ACCOUNT CUSTOMERS.

Ive had more than enough of Key Banks unethical tricks, i work for a living and don't believe in suing for a quick buck. This however is not personal, its business.

Key Bank is the worst, avoid this bank at all costs.

Here's the history: I had my accounts at Key Bank for 12 years. My business account ran almost $4 million through it during that time with varying balances.

A HOLD for $967 showed up from Macy's. I have never set foot in that store, it was obvious fraud. I contacted the fraud dept at Key Bank and was told they would investigate, it would take a minimum of 14 business days for the money to be returned, (stress minimum). They told me to speed it up to contact Macy's directly.

After literally 45 phone calls to Macy's, I finally spoke to somebody who didn't shoot me to a FULL voice mail box. I gave them the information and they said they'd look into it. 2 days later the hold was lifted. A week after that I received a letter from Key Bank stating the investigation was closed, the hold was lifted, all was well.

3 weeks later they took the money out of my account, all $967!!!!! I contacted the fraud dept at Key Bank again and was told the same story. I informed them that it was FRAUD and to put the money back into my account. They told me this story of I can apply for a line of credit blah blah blah. I interrupted the bimbo on the phone and told her to give Macy's the line of credit and give me back MY MONEY!!!!!!

3 days later and nothing from them. They failed to investigate the fraud a month ago, they have the responsibility to investigate ALL FRAUD charges, they didn't. They failed to do their due diligence, they are liable. And Macy's is horrible by the way, I'll never set foot in that criminal organization either.

Avoid Key Bank at all costs, and I pray everyday they go out of business.

What an awful company. These people are just not honest. They breach written contractual agreements EFFORTLESSLY. They make up rules as they go. Absolutely the worst real estate lending experience of my life. We pulled the plug, fired these jerks, and took a prime 5.5 Million loan package elsewhere.

Remember, if they would lie or be dishonest in one area, how can you trust them?

Worst bank I have ever done business with. I am opening a new account at a different bank and will soon be closing this one out. Hubby deposited a check in the ATM and the bank put a hold on the check minus $100.00 and charged us $225.00 in over-draft fees.

Almost $900 in overdraft fees over the weekend. And we have 10K in a Key savings account. Excessive? All transactions were approved via debit card, nothing more than $30. Watch for this one on the news, because we will be fighting back!

keybank sucks i see a class action lawsuit coming their way soon every 2 weeks they are chargeing me $38 for Pending I repeat Pending charges that didn't clear until after they charge me these fees if they would not charge you fees for PENDING transactions then my account would never be over drawn I think a lawyer should look into this I gladly give him my money instead of key bank. Yes I'm closing my account.

Keybank has been extremely poor regarding their overdraft fees. When this was pointed out to them, they said their fees are similar to Wells Fargo. What ... they think Wells Fargo is a shining example? Anyway, went in and paid cash to clear overdraft fees and make sure account was completely brought up to date. That night, they applied the overdraft fees for the items that had been below balance that day! So now we're negative again, without spending another penny! Spoke to branch manager. We fixed this. Happened again the next day, because the account was "negative" for the day (and another charge came in) that then spawned another overdraft fee! You can't keep up with their overdraft fees! Then I was charged a fee for not bringing my account balance up ... when I had personally gone in to make sure we paid the right amount of cash. Yep. Charged a fee on my overdraft fee negative balance! I've had enough!!!!

I feel everyone's pain. I admit I was responsible for the first overdraft, but Key bank gives no breaks when it come to their fees. I made a total amount of maybe $50 charges to my account in one day, not knowing someone I wrote a check to months ago had finally decided to cash it. I am paying $147 in overdraft fees on $50. One of their 'Tier 2' $38 overdraft fees was for a .99 cent itunes charge that cleared the same day I mad over $900 in deposits. The bank claims that previously authorized charges go through before deposits even if the two were made on the same day. That really means... we like to rip you off for as much as we can. I asked for a refund of this last $38 charge, not the other three charge because it was a $38 charge for .99 cent when I made deposits. I really don't want to go through the hassel of changing banks, but they really don't seem to be into cutsomer service. They claim I'm over my limit for fee waivers, but I don't remember getting any. Shame on KeyBank. I know I'm responsible for making sure my account is in the black, but why does my bank think it's okay to do this and over .99cent. Now they're going to lose my business.

At what point does Key Bank's raiding of my checking account become robbery? "Hello, officer, I'd like to report a bank robbery in progress. No, nobody is holding up a bank, the bank is stealing from my account." My account is nearly empty because of their regularly dipping their hands into my personal financial cookie jar. Guess what, folks? There ain't gonna be no more cookies put into that cookie jar!! We have three recourses, folks: one is a complaint to the FDIC; the other is an email to our senators and congresspeople asking for legislation to enact some sort of regulation on bank fees. What's happening should be illegal, it certainly is unethical. Third recourse: Anybody know a good attorney who would like to take on a class-action lawsuit? Count me in!! Key Bank has much deeper pockets than I do!

I am currently banking with Key & am in the process of closing my account. I have had NOTHING BUT TROUBLE with them! If only I read these reviews before opening the account! I, like several of you, have had unexplainabl overdraft charges on my account. Now they are trying to tell me there is nothing they can do because they have already courtesy'd my account within the past 12 months. I currently have 11 overdraft charges (at $38 a piece) and I have only 1 item that overdrew. Also, I noticed that daily they change the order in which things go through so that they can say I had no $$ in the account when in actuality I did! Has anyone had this problem? I am at whits end right now & don't know what to do. I am -171.00 because of overdraft charges & I don't feel as though I should pay them. I can't close the account until that is paid... they say. But, if I wait, I get charged ANOTHER fee for every 5 days its negative. What do I do? I really would love/appreciate someones help. I have contacted them, I took my statement book in, printed the online account each day to show it canges and they are saying there is nothing they did wrong. Does anyone have any suggestions that would help me out of this?!?! I have already gone through the process of opening a new account with another bank but I am afraid they are going to deny me because of what Key has done... Don't know what to do... Thanks for any help!!

I was at trustco but i just moved and there are no trustco banks where i live now so i switched to Keybank

Keybank has lost my business. I've been with them for sixteen years but this is ridiculous. I had charges go through the SAME day as a major deposit but because the "time" of the automated deposit supposedly went through after the charges they charged me $180 in overdraft fees that they won't refund. Even the overdraft notices show a postive balance the same time they are claiming overdrafts. It's a scam.

They took my debit card away because I made a few accounting errors. They also restricted their branch hours, made misrepresentations of available funds on their website, and their website is having maintenance every time I need to know what funds are coming through my account.

If they make an accounting error, which they do often (I've been in branches as they talk about how a certain accounting error was made on someone else's account) they try to blame you, but it's not ok to accidentally bounce a check, because they'll take away your account priviledges then, and you won't be able to deposit checks outside of banking hours, which they have restricted.

They also changed the funds availability policy to be more strict, so that they can charge more bounced check fees. The fees are all rather exorbitant in terms of how much you pay. Even if you have funds in your account, they won't hesitate to charge you the $38. Then, they'll try to sell you some useless overdraft protection that just serves to increase how much you pay to them overall (in interest).

They don't have very good customer service on the phone, and they are always trying to sell you something you don't need, even if you've said that you don't want to have telephone contact with their marketing department.

I find banking at Key Bank to be a great hassle.

Keybank is very disappointing and can be described as the worst bank experience I have ever had. I went in thinking I will open a checking account because of the free ipod promotion. They said it is simple and I had to do is fulfill three things.. get a student credit card from them, debit card, and online bill-pay. Everything went smooth until the credit card was declined. Of course, I would not have a high credit score if any at all because like many students, I am just starting up my credit history, and thus goes with the name student card. They said as a student, you should have at least six months of previous credit history in order to get this card and the free ipod. There was the catch, as always, a hidden detail never mentioned. As a result, Keybank would not fulfill their free ipod part of the bargain for opening up an account. Hours spent trying to figure this out with branch managers and phone calls to numerous 1800s and 1888s gave me nothing but sorry, I dont know what to do and heres another number. can i transfer you. Their promotional deal was definately a marketing campaign to lure people into their, albeit, sucky bank. But lucky for them, I will never be banking with them again and will give no recommendations to others. Keybank, learn how to do banking and gain customers, not push them away for life

Here's a letter I recently wrote to the president of KeyBank in regard to overdraft charges that STILL have not been explained to me (today is April 29). What a crappy bank. 0 stars if I could (account has been closed, so don't worry about the acct #)- April 4, 2007 Henry L. Meyer III, Chairman KEYBANK 127 Public Square Cleveland, Ohio 44114 Re: Account Number 440580058905 Dear Mr. Meyer: I would like to direct your attention to the above referenced account, which happens to be my checking account. (I only use a debit card.) I confirm my balance online almost every morning. According to Mondays (April 2) balance, and my own accounting, I had sufficient for my needs. This morning, however, I am faced with an entirely unforeseen situation. My account has deteriorated and for reasons I am unable to ascertain. If I made a mistake which is unlikely it was a small one. More likely, the account was manipulated by the bank, via the online information it provided me, to increase fees and penalties. You will notice that, at this point, I am already being charged fees upon fees. $32 is apparently not enough. The bank has added another $4.45. Yesterday, a local KeyBank vice president informed me that my problems would get much worse in the days ahead: according to him, fees and penalties would exceed $200. Actually, they are now past $400. This because I trusted your online balance to be, if not definitive, at least accurate. This because employees of KeyBank are entirely unable to explain how the online system works. Twenty minutes ago I received yet another version from Randi Brown, Asst. Manager at Crossroads KeyCenter in Salt Lake City, who is sending my account to collections. It must be satisfying to sit high up in your glass tower and anticipate the more or less effortless earnings this kind of graft produces. Yours is an odious and immoral undertaking, damaging not only to your customers and your country, but to your very soul. I cannot pay your fees. Even if I could, I would not. Key bank is a horrible bank just like US Bank. I have had nothing but trouble with both of them. I had no idea they were affiliated with each other but that's ok because I am going to 2 news with my story. I would give them zero stars if I could.

If I could give KeyBank zero stars, I would. They are the worst company (not just financial company) that I have ever had to deal with. I had a boat loan with them....now paid off. I am still waiting for a correct copy of the lien release. They have managed to give me 2 incorrect copies so far. And this is just the last of a long list of mistakes they have made during the course of the loan. THEY ARE INCOMPETENT, IMPOLITE, INACCURATE, AND INADEQUATE. DO NOT DO BUSINESS WITH THEM, THEY ARE THE WORST!!!

I would not recommend Keybank, I was moving not long ago, and did not know the rental truck and movers would cost more than I had budgeted, I was overdrawn for a few days, and the fees they charge are TOTALLY excessive! For being overdrawn for just a couple days until I could cover it (heck, I covered it as soon as I knew about it), they charged me $200+ in overdrawn fees! I think it is time for people to write their national reps and have them investigate these excessive bank fees and start regulating them better! Nope, not a bank I would recommend, and I am in the processo of dropping them, moving to another bank.
I also had a dispute with a company over a charge to my Mastercard/debit card. The business basically took my $500 and did nothing for me, so I disputed it with Keybank, Mastercard--they REFUSED to refund my money and reverse the charge despite my getting nothing for my $500!
So, have dropped Keybank, changed banks,and am in the process of writing complaints to those in charge of Keybank, Mastercard (oh yes, dropped MC too for Visa).

I have been a loyal and responsible Keybank customer for around 15 years. My recent experiences mirror those of canankee below. As stated, overdraft fees are charged in such a way as to earn Keybank as much money as possible before the customer has a chance to recover. I had $270 in overdraft charges before the first notice ever reached me. All the while I had thousands in other Keybank accounts under my name. Some of the fees assesed violate their own policies. It would seem they pay for the candy canes out of their profits on the overdraft charges.

KeyBank doesn't process debit/credit transactions over the weekend, so you end up with all of your withdrawls listed as "pending." When it finally does go through, they simply deduct the larger purchases first. This way, if you overdraw your account with the last purchase (the largest dollar amount), they can charge you overdraft fees on each smaller, previous transaction (i.e. $31.75 per $2-10 debit, adding up to over $400 in fees, when only one $120 transaction had actually overdrawn the account). IMHO, a horrible bank unless you have enough money to cushion your account so that overdrafts never occur.

Key bank has done alot of things recently to better themselves such as free checking and offering very good rates on loans and great deals on credit cards. most all the employees are wonderful and always willing to help. the only thing i feel the still need to work on are their fees.

Of course Keybank charges a fee when irresponsible customers overdraw their account. EVERY BANK DOES! Get a grip and stop whining about you not balancing your checkbook and blaming it on someone else. Or better yet, get overdraft protection so when you mess up, you don't get charged and end up looking for someone else to blame it on!

TOO MANY OVERDRAFT FEES!! I HAVE PAID OVER 700 DOLLARS THIS YEAR ALONE BECAUSE THEY TRY TO STEAL YOUR MONEY!! I WOULD NOT RECOMMEND THEM!

If you want to keep your money safe, don't use keybank .They make major errors, then charge a another fee on your account .Don't direct deposit at all .SAM

This bank is the worst you could borrough money from. If you are late with a payment,they do not accept any hospital or death in the family. What kind of bullshit is this. They are cheap and the workers are not very polite. If I had the money I would pay them off if I could. I dislike them alot. They do not work with you they go against you. thank you DAA

They charge fees on everything if you have the standard checking account. For using your debit card. For using another bank's ATM - yes, they charge you a fee in addition to the fee charged by the bank that owns the ATM so you get charge twice for one transaction. For using your card abroad. Etc.

Key Bank keeps your money safe, and the tellers there are very nice, and they give out candy canes and junior mints.
