Harry Blackmon II. Should have rightfully been Robert Bork's position on the bench until his last name became a verb. Instead we have been treated to two decades of psychobabble from this less than brilliant jurist who has seeked every avenue of explanation for his decisions other that the text of the constitution. In the recent Roper decision he continued a trend by jurist to rely on foreign law to determine a standard that he wished to apply while striking down the will of the people. The most subversive and nefarious practice he engages is planting terms in dissents then grasping upon that terminology in future cases to promote a course of ideology he deems ethical. Look at cases like Hardwick or Bowers regarding sodomy laws and then see how the terminology is progressed to defend an agenda they wish to eventually arrive at- a right to gay marriage.

I like how people critcize conservative judges for not doing the right thing. That's not the job of courts. They are not on the bench to invent new rights and stomp on the rights of legislators. Sadly, Kennedy sometimes loses sight of that fact and gets swept up with O'Connor and the active three on the left.

This guy is intelligent, but so wrong-minded. He has more on the ball as a jurist than any of the other rightwingers on the High Court, but he just can't find it in himself to Do The Right Thing, but instead insists on being just a another bagboy for the drooler faction. Too bad. A waste of talent.

LOL it's so funny that the 4 right wing judges are at the bottom. Just goes to prove that most conservatives don't even know one from the other as I'm sure they would give them high marks if they knew. They're fooled by bush's lies.

A mostly unknown among the Justices. His namesake adds little fame to a Justice whose service in undistinguished.
