Depends. Small scale maybe, but when its on the scale of the Enron boys, or some of the other massive embezzlements, this isn't adequate.

Unless we're talking an insignificant figure, a crime in which a trust is violated should be punished a bit more severely.

I always find jail time for non-violent offenses difficult unless the result of the crime has a devastating impact on the lives of others. In this case that could be very possible. Yet fining the individual as percentage of net worth would probably be more justifiable.

If Judges would hand out stiff sentences for all crimes there would be much less apathy amoung lawbreakers.
