Simply a falsehood promoted by the courts to fill voids wanting of power in a systemically flawed process while assuming authority not granted to it. The 14th amendment guaranteed due process and in essence applied only the 5th amendment to the states. The concept of substantive due process applied in cases regarding the 1st amendment is therefore an inherent contradiction.
