I can list 50 people more qualified for the position than Harriet Miers... probably more. She was simply unqualified and that's that. It's not that she's not the best choice, but she's so far down the list. I KNOW we could have done better. Even W could have done better. Why not?

There are better intellectually and academically qualified candidates out there. That's not to say she's awful, she's just not the top of the heap of what could have been selected.

Absolutely the most unimportant criteria for judgment on this list. Best choice from what standpoint? Political? Legal qualifications? Predictability of her decisions based on her track record? Likelihood of approval? Gender? Souter and Kennedy probably passed this test at the time of their nominations, what did the country get from that? The ultra left-wing of judicial ideolgy when joined with Ruth Bader Ginsburg. Anyone opposed to the conservative momentum of the court should love this nomination. This type of appointment has not been a winner for conservatives.
