Seriously, I had that happen to me. When I was twelve, I got a top which was activated by a push button, and lit up while it was spinning. My friends and I were having a good time playing with it for about ten or fifteen minutes. The thing finally busted while spinning, and the pieces scattered across the kitchen floor! Well, at least I still had my camera....

I would think it would be the manufacturer, unless there was stomping, pounding, and throwing going on.

When I was little I got this toy dog that walked around and barked. I smashed it up real good that same night with my other gift, a new hockey stick. My folks wouldn't let me get a real dog until I was a teenager, specifically because of that night.

This did not happen to me but it happened to my cousin (who had behavioral problems along with ADD). Every year, he'd get a cool toy for Christmas and he'd break it within the next 2 hours.
