Unfortunately, so-called "reformers" view the small percentage frivolous lawsuits in this area as justification to limit the damages available for individuals who truly have been victimized by severe negligence on the part of a physician. Some states have even limited the amount of punitive damages available to victims to $250,000 (the President is seeking a similar limit at the federal level), which is wholly inadequate for an individual whose life has been ruined by the negligence of a physician. The notion that damages for actual victims should be limited in the name of protecting doctors and cracking down on frivolous lawsuits is insulting and fallacious.

 | irishgit (155) 02/11/2006 | More often than not, these are fully justified. As is the case with every item on this list, examples can be found of frivolous and unjustified suits, but for a variety of factors, most cases in this category are pretty legitimate.
