 | GenghisTheHun (177) 10/11/2007 | Now before everyone gets the vapors over this, the facts need be known. Many such cases cannot be prosecuted for a great number of reasons.
1. Lack of evidence to convict;
2. Reluctance of witnesses;
3. Length of time since the alleged event;
4. Prosecutor does not think a conviction can be gained;
5. Defendant is over-charged;
6. Prosecuting witness have no credibility;
etc. etc.
Most judges are not morons, so something else may or may not be afoot. Also the prosecutor usually gets to make a recommendation and the probation office might be involved. Really, what are the facts in this case? Does anyone on this site know?

 | gumshoedetective (1) 10/11/2007 | Strange, but this judge use to be ( many years ago ) conservative in his sentences. We, the people, should elect judges. We have to rely on the majority being sane, but when it gets to the point where the majority are fools; it's all over anyway.

 | Loerke (52) 01/17/2007 | I wouldn't defend the judge (or, obviously, the convict), but it's a real stretch to claim that this one case illustrates the complete decline of our nation. The amount of outrage directed at the case indicates that it is an anomaly. We have a higher rate of incarceration than any other First World country. So a better indication of our decline as a country is the number of people IN prison, rather than the number of people NOT IN prison.

 | souljunkie (21) 03/09/2006 | I can only say this here; What reason could any judge give you to hand out this sentence for raping your child? Should I care about getting treatment for the rapist after the fact? Noble thought but realistically, thats a crock of Sh--!.

 | Jed1000 (74) 03/09/2006 | I'm not defending him here.. but apparently his motivation was that the offender would get no treatment for his "problem" in jail, but he would if he were on parole. The judge later "re-thought" his sentence and the offender will be getting some jail time. Good move.
A well-meaning but logic-challenged judge making a bad decision in no way comes close to proving that "America is not America anymore." Give me a break here.

 | Vudija (98) 03/09/2006 | It's horrible and unfortunately, it happens in more places than Vermont. Texas has the same issues; although mot so much anymore and Florida (we won't get me started on the justice system in THIS state regarding this issue).
Genghis: As for your statement; this may be true in some cases, especially those where the victims wait to report the crime...but...I've seen and heard of many cases either being thrown out or justice just plainly was not served as harshly as should have been and not for lack of evidence or credible witnesses. I don't know WHY, but a monkey could have been both jury and judge, and saw how guilty some of those people were and they were still not given punishment befitting the crimes against them. Especially in these cases, I think the punishments should be far more harsh than they currently are.
