 | Drummond (54) 05/11/2006 | This debate actually did take place in some of the most contentious exchanges in Supreme Court history, but it's all in writing and limited to the issues of the particular cases. Brennan, originally a Republican became probably the most ideologically liberal judge in US history, and Scalia is along with Thomas the most ideologically conservative. It would have been great to see them going toe-to-toe in a live debate on issues such as the interpretations of due process, the 9th and 14th amendments, the commerce clause, original intent vs. living document, etc.
